Terms and Conditions
1. General
These Terms and Conditions (“Terms”) govern all bookings, rentals, and usage of vehicles provided by Drive Set Go Pvt Ltd under the brand name RideMyCar (“we”, “our”, or “the Company”). By booking or using our services, the customer (“you”, “your”, or “the renter”) agrees to be bound by these Terms in full. These Terms constitute a legally binding agreement between the Company and the customer and apply to every booking made through our website, mobile platforms, or any authorized partner.
2. Booking and Confirmation
All bookings are subject to vehicle availability and confirmation by the Company. A booking is confirmed only after the customer makes the required advance payment through our official channels. The advance amount is non-refundable under any circumstances. Once the vehicle is reserved, cancellation or modification of the booking is not permitted. RideMyCar reserves the right to refuse or cancel any booking at its discretion, including but not limited to cases involving invalid documents, security concerns, or misuse history.
3. Vehicle Usage Policy
The rented vehicle is strictly for personal, non-commercial use only. It must not be used to carry passengers for hire, transport goods, participate in races, rallies, or off-road events, or perform testing or training activities. Subletting or transferring the vehicle to another individual is strictly prohibited. The vehicle shall be driven only by the customer or any person pre-approved by RideMyCar at the time of booking, provided that such person holds a valid driving licence and complies with all traffic and safety laws of India.
4. Driving Licence and Documentation
The renter must present a valid Indian driving licence, original government-issued photo ID proof, and booking confirmation at the time of taking delivery. The customer must ensure that all information provided to the Company is accurate and up to date. Any falsified documents or misrepresentation will lead to booking cancellation without refund and may result in legal action. The customer must carry the necessary documents at all times during the rental period as required under Indian Motor Vehicle laws.
5. Vehicle Handover and Return
The customer must inspect the vehicle thoroughly at the time of pickup. It is strongly recommended to record a short video or take clear photographs of the vehicle to document its condition. Once the customer accepts the keys and vehicle documents, it is assumed that the vehicle has been received in proper condition. The vehicle must be returned at the designated time and location mentioned in the booking confirmation. Late returns will attract a late fee of ₹300 per hour, and delays beyond 1 hours may be treated as an additional day’s rental. The vehicle must be returned in the same condition, with the same fuel level as provided, and in a clean state.
6. Fuel, Tolls, and Parking
Fuel is not included in the rental amount. The customer must return the vehicle with the same fuel level as at pickup. Any shortfall will be charged based on current fuel prices along with a service fee. All tolls, parking charges, state entry taxes, and penalties during the rental period are the sole responsibility of the customer. The Company will not reimburse or bear these expenses.
7. Damage, Repairs, and Maintenance
The customer is fully responsible for any damage to the vehicle occurring during the rental period, whether caused by accident, negligence, improper use, or violation of these Terms. This includes but is not limited to damages to the clutch plate, clutch belt, gearbox, tyres, or interior parts. In the event of damage, the customer must immediately inform RideMyCar and not undertake repairs without approval. If the vehicle remains under repair due to customer-caused damage, daily rental charges will continue until the vehicle is returned to operational condition. Any towing or recovery expenses (for example, towing from another city back to Pune) must be paid by the customer.
8. Speed Limits and Driving Conduct
A strict speed limit of 80 km/h must be observed at all times. Any overspeeding beyond this limit will incur a penalty of ₹2,000 per instance, as recorded by GPS or onboard telemetry. Reckless or aggressive driving, driving under the influence of alcohol or drugs, or using a mobile phone while driving are strictly prohibited. If such behavior is detected or reported, the Company may immediately terminate the rental without refund and blacklist the customer from future bookings.
9. Prohibited and Illegal Activities
The use of the vehicle for any illegal or criminal activity is strictly prohibited. This includes but is not limited to driving under the influence of alcohol or narcotics, transporting illegal substances, carrying weapons, kidnapping, smuggling, or engaging in any act that violates the laws of India. If the vehicle is involved in any such activity, RideMyCar reserves the right to immediately terminate the booking, seize the vehicle, and report the matter to law enforcement authorities. All legal and financial liabilities arising from such acts shall rest entirely with the customer. The Company will not be held responsible for any police, legal, or court proceedings resulting from the customer’s actions.
10. Accidents, Injury, or Death
In the event of an accident, injury, death, or property damage occurring during the rental period, the entire responsibility lies with the customer. The Company will not be held liable for any direct or indirect loss, injury, or death of the driver, passengers, or third parties. The customer must immediately report the accident to the local authorities and to RideMyCar. Any insurance claims, deductibles, medical costs, or legal consequences arising out of the incident are the sole responsibility of the customer. The Company provides the vehicle only after verifying the customer’s driving licence and identity documents; therefore, once the vehicle is handed over, the customer assumes full legal and financial responsibility for its use.
11. Insurance Coverage
Where applicable, the vehicle may be covered under standard motor insurance as required by law. However, such insurance does not cover negligent driving, illegal activities, unauthorized drivers, driving under influence, or intentional damage. The customer is responsible for paying any insurance deductibles, damages excluded from coverage, or losses arising from non-compliance with insurance terms.
12. Cleanliness and Smoking Policy
Smoking, drinking, or carrying alcohol inside the vehicle is strictly prohibited. Violation of this rule will result in a ₹1,000 fine and may lead to termination of the rental. Vehicles must be returned in reasonably clean condition. If the car is returned excessively dirty or with stains, cleaning charges will be applied.
13. Indemnity
The customer agrees to indemnify, defend, and hold harmless RideMyCar and Drive Set Go Pvt Ltd, along with their officers, employees, and affiliates, from and against any and all claims, losses, damages, liabilities, penalties, costs, or expenses (including legal fees) arising from or related to the customer’s use of the vehicle, breach of these Terms, or involvement in any illegal act. This clause ensures that the Company bears no responsibility for any act or omission by the customer that results in legal or financial consequences.
14. Termination and Repossession
RideMyCar reserves the right to terminate the rental agreement immediately and repossess the vehicle without prior notice if the customer breaches these Terms, fails to make payments, misuses the vehicle, or engages in any illegal or unsafe activity. In such cases, no refunds or adjustments will be provided, and the Company may pursue legal action for recovery of damages.
15. Governing Law and Jurisdiction
These Terms are governed by and shall be construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra.
16. Amendments
RideMyCar reserves the right to amend, modify, or update these Terms & Conditions at any time without prior notice. The latest version will always be available on the official website, and continued use of our services constitutes acceptance of the updated Terms.
17. Acceptance
By booking, making payment, or taking delivery of any vehicle from RideMyCar, the customer acknowledges that they have read, understood, and agreed to all the Terms & Conditions stated herein.
